Healthcare Law Review – India

 

India’s healthcare ecosystem has the potential to become more equitable and sustainable. Recent initiatives have shown progress in healthcare, including improved primary care, expanded insurance coverage and increased availability of generic medicines.

On 8 July 2022, the MoHFW released a draft of the Drugs, Medical Devices and Cosmetics Bill, 2022 to replace the current D&C Act to regulate online pharmacies, clinical testing, medical devices, ayurveda, sowa rigpa, unani and homeopathy, along with provisions for advisory boards. On 26 April 2023, the MoHFW notified the National Medical Devices Policy, 2023 , to adopt a patient-centric approach with an emphasis on medical devices’ quality, safety and efficacy.
